Distinguish the judgment from actual enforcement
Keep the court decision, confirmation of its entry into force, enforcement document and proof of submission. Identify known payments and actions by the debtor after judgment. The same debt must not be treated simultaneously as wholly unpaid and partly paid without explanation.
What to gather to assess the situation
- Case and enforcement proceeding numbers, if proceedings have been opened.
- Decisions and responses already received.
- Submitted applications with proof of sending or receipt.
- Information about amounts received and their purpose.
- Dates of the latest actions known to the judgment creditor.
The database helps locate proceeding details but does not replace review of the file. An allegation of inaction must relate to a specific unperformed action and actual circumstances, rather than merely the absence of the desired result.
Before applying again, list applications already submitted and responses received. This helps identify the subject of the next inquiry and avoids repeating actions without considering the current enforcement stage.
